Terms of service
General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions apply to all orders placed by customers through the online shop of Ora Sleep GmbH, Nordstrasse 13, 8580 Amriswil (hereinafter referred to as “Mila”). By placing an order, the customer accepts these GTC in the version valid at the time of the order.
2. Conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the [Buy now / Order with obligation to pay] button, the customer places a binding order for the goods listed on the order page. The purchase contract is concluded when Mila accepts the order by sending an order confirmation by email immediately after receiving the order.
3. Prices and shipping costs
3.1 All prices are in Swiss francs (CHF) including statutory value added tax (VAT). 3.2 Mila offers free delivery within Switzerland and the Principality of Liechtenstein. No additional shipping costs are charged to the customer.
4. Payment terms
Mila offers various payment methods, including:
Purchase on invoice & instalments via PowerPay (credit check by PowerPay)
Bank transfer
Twint
- Credit cards
Purchase on invoice with instalment option (POWERPAY)
MF Group / POWERPAY offers the payment method “purchase on invoice” as an external payment service provider. With the single invoice you can simply settle your online purchase by invoice. If you do not pay within the given time frame, you will subsequently receive a monthly invoice with an order overview in the following month.
Upon conclusion of the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment arrangements. When purchasing on invoice, in addition to our GTC you also accept the terms and conditions of POWERPAY (powerpay.ch/de/agb).
5. Delivery
Delivery is made to the delivery address given by the customer within Switzerland. Information on delivery times is indicative and not binding unless expressly agreed otherwise.
6. Retention of title
The delivered goods remain the property of Ora Sleep GmbH until payment has been made in full.
7. Voluntary 100-day right of return (trial sleeping)
7.1 Going beyond the statutory requirements, Mila grants a voluntary right of return of 100 days in total from receipt of the goods (bed and mattress).
7.2 To make use of the right of return, the customer must inform Mila in writing by email to info@mila-bett.ch within the 100-day period.
7.3 The return is free of charge for the customer. Mila organises collection of the goods directly from the customer at the delivery address.
7.4 After the goods have been successfully collected and checked, the full purchase amount is refunded via the original means of payment.
⚠️ Important exception to the right of return
Please note that returns and withdrawal are expressly excluded if the goods (bed frame or mattress) were ordered in the wrong size. Because we plan our beds and mattresses to order for you, we ask you to check the dimensions of the room and the mattress size you need carefully before buying.
8. 5-year guarantee
Mila grants a guarantee of 5 years from the date of delivery on the Mila Cloud children's bed. This guarantee covers defects in material and workmanship. Damage caused by improper handling, normal wear and tear or external influences is excluded. In a guarantee case, Mila decides whether the affected part is repaired or replaced.
9. Warranty and liability
The statutory warranty provisions apply. Mila's liability is limited to intent and gross negligence. Liability for indirect or consequential damage is excluded to the extent permitted by law.
10. Data protection
Personal data is collected and processed in accordance with the provisions of the Swiss Data Protection Act (DSG). Further information can be found in the separate privacy policy on the website.
11. Final provisions and place of jurisdiction
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. Swiss law applies exclusively. The place of jurisdiction is Amriswil (TG), unless a mandatory statutory place of jurisdiction (e.g. the consumer's place of residence) applies.
